1. Offer and conclusion of contract



The order made by the buyer is a binding offer. We can accept it within two weeks by sending a confirmation of the order or shipping of the goods.


2. Prices and payment



Payment is to be done in advance in all cases. We offer one possibility: payment by credit card.
Only after receipt of payment, the order can be shipped.
All prices indicated include the VAT. Shipping costs thereby incurred are stated separately.

3. Delivery time



The availability of each article is shown on the accordant page. If an article should not be available however, the buyer will be informed by email.


4. Revocation



Right of Withdrawal
The buyer can withdraw from the contractual statement within a period of two weeks without reason in writing (e.g. letter, fax, email) or or if the goods have already been delivered before the end of this period to return the goods. The period begins upon receipt of this notification in writing, but not before receipt of the goods at the receiver (in the recurring supply of similar goods before receipt of the first partial delivery).
For the adherence to this period the punctual sending of the revocation or the goods.

Consequences to the revocation
In case of a valid revocation, all performances received as well as benefits taken (e.g. interest), if applicable, are to be restituted by either side. If the buyer is unable or partially unable to restitute the goods to us or can only restitute it in a deteriorated condition, then the buyer has to insofar compensate for its value where applicable. This does not apply if the deterioration is exclusively due to examining the goods ? as for instance in a retail store ? or putting the goods to their intended use. Goods that can be shipped by parcel are to be returned on our the risk. Goods that cannot be shipped by parcel will be picked up. The buyer is obliged to bear the costs of the return shipment, if the merchandise delivered corresponds to the merchandise ordered, and if the price of the merchandise to be sent back does not exceed an amount of forty euros or if, where the price is higher, the buyer has at the date of the revocation not yet rendered consideration or given a part payment. In all other cases, the return shipment for you is free of charge. All reimbursement obligations must be fulfilled within 30 days of the declaration of revocation.
The period begins for the buyer with sending the declaration of revocation or the goods, for us with their receipt.

5. Warranty



Please claim immediately visible material or fabrication defects among which are also damages caused during transport by informing us and the member of the forwarding agency or parcel service company who delivers the goods.
For all defects within the defects liability period of two years exist the statutory standards for supplementary perfomance, removal of defects respectively new delivery and if applicable withdrawal. Exempt from this are wear parts such us light bulbs etc. and improper us of the goods.

Furthermore you have the right to correct, to block or to cancel your data. In case of legal and contractual periods of retention or those relating to commercial and / or tax based law, your personal data is blocked instead of being cancelled.

10 - APPLICABLE LAW - DISPUTES - EVIDENCE

In the event that any clause of this contract is deemed null and void due to a change in legislation, regulation, or a judicial decision, this shall in no way affect the validity and adherence to these general terms and conditions of sale.
16.2 - Evidence
The computerized records, maintained in the computer systems of geodus.com and its partners under reasonable security conditions, shall be considered as evidence of communications, orders, and payments occurring between the parties.
16.3 - Storage and Archiving of Transactions
The archiving of purchase orders and invoices is carried out on a reliable and durable medium so as to correspond to an accurate and lasting copy in accordance with Article 1348 of the Civil Code.
16.4 - Applicable Law and Jurisdiction
These conditions are subject to French law.
In the event of a dispute and in the absence of an amicable agreement between the parties, jurisdiction is conferred upon the competent courts of Strasbourg (France). In case of incompetence, jurisdiction falls to the courts near Strasbourg, regardless of the plurality of defendants and/or third-party proceedings, even for urgent procedures or conservatory proceedings in summary or by petition.
16.5 - Language
The language of this contract is the english language. In the event of discrepancies between versions of the contract translated into different languages, only the French version shall prevail.
