Conditions of Use. CONCERNS These conditions define the sales modalities between geodus.com and the users, from the setting up of an order to the delivery. They determine all stages of an order and the order tracking. Geodus.com reserves the possibility of adapting or of modifying constantly the present conditions. In the event of modification, it will be applied to each order the general conditions of sale in force at the day of the order. The present conditions cancel and replace the preceding ones as from July 1, 2007 ARTICLE 1 - PRICES 1.1 - All orders, regardless of their country of origin, are payable in € (EUR) or £ (GBP) or $ (USD). The conversions in other currencies (proposed on some pages of the Website) are only for information and are not contractual. 1.2 - the "Geodus price", which is indicated on the different pages of the Website, corresponds to:
1.3 -Geodus.com reserves the right to modify its prices constantly but the products will be invoiced on the basis of the tariff in contractual currency (€ or £ or $) valid at the time of the recording of the order. 1.4 - the products remain the Geodus.com property up to the complete payment of the price. However, starting from acceptance of the delivery by the customer, the risks of the supplied goods are transferred to the customer. 1.5 - Best Price Guarantee Geodus refunds you the difference if you find the same article (new one, same brand, same sphere material, ...) in Europe, cheaper, on the web (schipping costs included) or in a shop, within a period of 2 weeks after payement. Just send us a mail detailing the globe datas (price of better offer, reference, ...) and (web)shop datas (adress, web site, ...). After verification, we refund you the difference under 2 days. Be carefull of the sphere material and stand material; some globes exist with plastic sphere and crystal sphere (much more expensive). ARTICLE 2 - ORDER The orders are booked on the internet website: www.geodus.com. Contractual information is presented under written form in English, French and German. Contractual information will be the subject of a written confirmation at the latest at the time of the delivery. Geodus.com reserves the right to cancel or refuse any order of a customer, for any reason, in particular with whom there would be a litigation relating to the payment of a former order. Geodus.com controls all the orders which are booked on its site. These controls aim at protecting Geodus.com from abuses operated by defrauders. Within the framework of these procedures, the Customer Service (see Article 11) could be brought to require all the parts necessary of the releasing of your order: proof of residence, etc... ARTICLE 3 - VALIDATION You state to have taken knowledge and accepted the present general Conditions of Use before booking your order. The validation of your order is worth acceptance of these general Conditions of Use. ARTICLE 4 - AVAILABILITY Our offers of products and prices are valid as long as they are visible on the site, within the limit of available stocks. For the products not stored in our warehouses, our offers are valid subject to availability by our suppliers. For the products not stored in our warehouses, indications on the availability of the products are provided to you at the moment of the booking of your order. Availability informations are coming directly from our suppliers, and errors or modifications may exceptionally exist. In this case, we will inform you by e-mail, as we get the unavailibility information from our suppliers. We will then propose you some alternatives; one of these alternatives will be inevitably the pure and simple cancellation of your order with immediate refunding if your bank account were output. ARTICLE 5 - DELIVERY AND SHIPPING COSTS 5.1 - General notes The products are supplied to the delivery address that you indicated during the order process. For follow-up reasons, we don't deliver to P.0. boxes. The delivery date,indicated on the item page, is given as an example; it is not contractual. If you order several products at the same time with different delivery dates, the delivery date of the whole order will be the longest period. Geodus.com reserves itself the possibility of dividing the dispatch. Possible forwarding expenses will only be charged once. Geodus.com cannot be hold responsible for the consequences of delayed deliveries. Each order, which was not sent within 30 days, is cancelled (except if announced in the item page and on your order ). Customer Service is at your disposal to give you estimated delivery dates for countries outside Europe. In the event of delay of forwarding, an e-mail will be addressed to you. In this case, and as long as the product is not dispatched, you can always cancel your order. We invite you to consult the "where is my order" page and to contact the Customer Service for any question. If your order is payed by bank transfer, order treatment only starts at the reception of your transfer. The indicated delivery times are to be extended in consequence. 5.2 - Delivery problems You must check the conformity and integrity of the goods delivered before signing the delivery slip. The goods are considered conform if you, or a person that you authorized, signs the delivery slip. You must notify to the conveyor and also to Geodus Customer Service (see Article 11) all reserves on the delivered product (for example: damaged parcel, already open...) in the 3 days following the reception of the product. 5.3 - Forwarding expenses The free shipping over 30€ or 20£ zones are detailed on the item page. For the other zones (not European countries for example) please contact Customer Service to get shipping costs. ARTICLE 6 - PAYMENT The different payment methods are:
Payment is done directly on the secured servers of our bank "Caisse d'Epargne"; you will be automatically redirected to the bank site. We don't have any access to the information you exchange on the private bank site. For more information, you can see the website of the bank www.spplus.net (in french). Credit Card service costs E.U. countries: in accordance with European Regulation 2560/2001, customers should pay no more to withdraw euros from cash machines or make card payments in euros in other EU Member States than they pay for the same services in the country where they live. Banks generally don't apply service costs for credit card payments. Non E.U. countries: your bank will ask you some service costs. Please ask your bank. Name on your bank statement Columbus Verlag (editor of Geodus) is the name that will be written on your bank statement. 6.2 - Bank Transfer The transfer must be emmited in Euros only towards our german account (you get the account Nr -IBAN-, the BIC and SHARE during the checkout process). Vous can make the transfer at your bank-counter or by Internet if your bank proposes this service. IMPORTANT : The treatment of your order begins after crediting our account (generally 3 to 5 days after your bank transfer order); in consequence the indicated delivery dates are to be extended. Transfer costs E.U. countries: in accordance with European Regulation 2560/2001, cross-border bank transfers in euros within the EU will cost the same as domestic transfers. Whether your bank applys domestic transfer costs depends on your country and your bank (for example Germany: transfers are generally free for online banking); please ask your bank. Non E.U. countries: your bank will ask you some transfer costs. Please ask your bank. Name on your bank statement Columbus Verlag (editor of Geodus) is the name that will be written on your bank statement. ARTICLE 7 - SECURITY Payment with credit card is done on the private high security server of the bank. We don't have access to the information (card number) you exchange with the bank. ARTICLE 8 - SATISFACTION GUARANTEE 8.1 - You have a 7 days deadline as from the reception of the parcel to return us a product that doesn't please you no longer. We give you money back (see Article 10) less the sending costs we effectively paid (even if they are part of a "free shipping" offer). The return shippment costs are at your charge. Only the price of the products bought on the site will be refunded. The returns are to be carried out according to the procedure described in article 15 "Returns". 8.2 - This offer doesn't concern the magnum globes (which are specifically manufactured on order), the audio, video recordings or data-processing software. The incomplete, damaged, dirtied returns are not accepted. ARTICLE 9 - DEFECTIVE PRODUCTS AT DELIVERY We commit ourselves to replace you a product that is defect at delivery. Return shipping costs of the defective product (from you to Geodus) are at our charge . The return must be done according to the procedure described in article 15 "returns" to be valid. The return request (see Article 15 "Returns") must be placed within fifteen days after delivery. After this period, returns cannot be accepted. ARTICLE 10 - REFUNDS Refunds will be made within 15 days after validation of your return. Each full or partial reproduction of geodus.com website is strictly forbidden. 12.2 - Some products, in particular software, have personal and specific conditions of use, which may restrict the right of copying, public spreading, rent, ... Their general conditions of use must be respected, and geodus.com could not be hold responsible for the uses done out of their general conditions. ARTICLE 13 - RESPONSIBILITY The products on the Geodus website are in conformity with the valid german legislations. The responsibility of Geodus.com could not be commited in the event of non-observance of the legislation of the country where the products is delivered (for example in the event of prohibition of a title, controlled prices of certain articles...).It stays up to you to check with your local authorities the possibilities of importation or use of the products or services which you plan to order. The photos are purely illustrative and are not not contractual (color or form differences can exist between the picture and the real article). We invite you to refer to the written description of each product; in the case of doubt, don't hesitate to contact the Customer Service. Geodus.com is only responsible for the content of the website it publishes. Geodus.com will not take responsibility for all indirect damage that the product could cause like e.g. working losses, profit losses, luck losses, damage or costs, which could occur because of the purchase of the products. We remind you that it is careful to protect the data which are contained in some products. Total or partial impossibility to use some products, in particular due to incompatibility of material, can not give place to any compensation or refunding or blamed for the responsibility for geodus.com. ARTICLE 14 - GUARANTEE Globes bought on geodus.com have a warranty of one year. The invoice we sent you is considered as guarantee. The return must be done according to the procedure described in article 15 "returns" to be valid. The guarantee does not cover: - the replacement of the wear parts (batteries, bulbs, fuses, ...), - the abnormal or inappropriate use of the products. We invite you in this regard to read the instructions-for-use supplied with the products. - the failures due to the accessories (electric cable, ...), - the errors and their consequences, which are to due to the intervention of a non certified craftsman, - the errors and their consequences, which are due to an external cause. ARTICLE 15 - RETURNS The return of products, related in article 8, 9, 14, must be done according to the following procedure:
The parcel must be sent back at a maximum period of 15 days after issuing of the return number. After this period, the return number is no longer valid and the whole procedure must be started again.. ARTICLE 16 - LAW TO BE APPLIED - LAW CASES - PROOF 16.1 - Integrality On the assumption that one of the clauses of this contract would be null and not avenue by a change of legislation, regulation or by a decision of court, this could not affect, in no case, the validity and the respect of the other clauses of these general conditions. 16.2 - Proof The electronic records, preserved in the information systems of Geodus.com and its partners under reasonable safety conditions, will be regarded as the evidence of the communications, the orders and the payments occurred between the parts. 16.3 - Filing of the transactions The filing of the orders and the invoices is carried out on a reliable and durable support so as to correspond to a faithful and durable copy in accordance with article 1348 of the french civil code. 16.4 - Law to be applied and competence The present conditions are subjected to the german law. The attribution of competence in the event of litigation, and in the absence of friendly agreement between the parts, is given to the courts of competent jurisdiction of Sigmaringen (Germany), and, in the event of incompetence, to the jurisdictions near Krauchenwies(Germany), notwithstanding plurality of defendants and/or call in guarantee, even for the emergency procedures or the procedures academies in summary procedure or by request. 16.5 - Language The language of this original contract is French. In the event of contradictions between the versions of the contract translated into various languages, only the French version is taken. ARTICLE 17 - PRIVACY POLICY Your personal informations and datas are necessary for the administration of your order. Geodus takes multiple steps - including administrative, technical and physical measures - to protect your personal information against the risks of loss, theft and abusive employment, like from any unauthorized access, disclosure, modification and destruction. The respect of your privacy is very important for us; we don't sell your co-ordinates to other companies.
